
Bob Barr is slated to be the only presidential candidate on the ballot in Texas after Republicans and Democrats missed the Aug. 26 deadline to file in the state.
"Unless the state of Texas violates its own election laws, Congressman Barr will be the only presidential candidate on the ballot," says Russell Verney, campaign manager for the Barr Campaign and the former campaign manager for Ross Perot. "Texas law makes no exceptions for missing deadlines."
Ohhhh that's hilarious. They'll give them extensions though. Pity. It'd make the election interesting.

I live in Texas, just north of Dallas, and this just made me roll with laughter. I know Texas won't go blue, not yet despite the growing number of Texas democrat stickers I'm seeing on cars, so I have to wonder how the election totals would look were this allowed to stand.
KF's right though, they'll offer extensions because it just wouldn't do for the repubs to not vote for the (R) on the ballot. I mean seriously, we're talking about the state that actually re-drew the district lines to keep democrats out of office.
I swear, when Obama takes the White House you'll see a rash of "heat stroke" victims down here from people that just can't take the change.
The election code Barr's relying on only applies to those who don't automatically qualify. Texas has an automatic qualification cause - which both major parties meet. Ergo the premise of the article (Barr's accusation) is faulty. Texas need not revise, adjust, or extend anything. Obama and McCain are fine just as they are, under current rules.

The August 26 deadline is for independent and third party candidates. -- Texas Election Code - Section 192.031
Since the D's and the R's nominate by convention, and those parties have each had "a nominee for a statewide office who received a number of votes equal to at least five percent of the total number of votes received by all candidates for that office," Texas Election Code Section 181.005 applies.
A political party is entitled to have the names of its
nominees placed on the ballot, without qualifying under Subsection
(a), in each subsequent general election following a general
election in which the party had a nominee for a statewide office who
received a number of votes equal to at least five percent of the
total number of votes received by all candidates for that office.
Both the Republicans and Democrats had candidates for statewide office in 2006 who garnered more than 5% of the vote for that office (several, actually). Therefore, both parties automatically qualify and don't have to separately qualify by submitting names arrived at by convention by any particular date.

What does this mean now?
Nothing. It means that Texas will admit that their deadlines are meaningless if you're a major party candidate.
To Governor Perry,
It is imperative that you allow both major candidates to submit their filings to be on the November ballot. No matter what happens, you cannot run the risk of disenfranchising the millions of voters who want to have their voices heard and want to have a part in democracy. It would be a tragedy if you did not do all that is necessary to ensure a fair and level playing field by putting both major candidates on the ballot this fall.
We sincerely hope you will follow our leadership by honoring this request.

Given the passage into law by both democrats & republicans which limit, destroy, alienate and disregard the constitution of the United States of America, disregarding the law (advocated by some here) is exactly what any one can expect. After all, who in elected or administrative power will act contrary to their interests? GW Bush showed them the way.
One merely examines AE911truth.org or loose change 2 or zeitgeistmovie.com, perhaps better the results of the me too media steering even after the all too real financial disaster driving down the value of the US dollar and how FDIC doesn't have enough to pay as the rash of bank collapses so it needs to double its capital just to stay afloat or election machines with NO paper trail.
Despite the rhetoric, this election is about money and power being amassed in Washington agencies, corporate and individual "sponsors" - the 3 percent returned to the public pale compared to the vast bulk going to the military and banking to pay for the out of control debt. Some have written that one of the primary motivations Bush had to pretexting his way into War with Iraq was their switch to the Euro dollar and ditching the US (universal oil trading dollar). How can that be? Well, consider this, if oil suppliers dropped the US dollar in favor of some other exchange, then the US dollar could offer its massive debt and not enough GNP to back the debt. Humm, a currency backed by owing more than its worth.
Many have said that Americans own this debt as so much of the US dollar debt is based on entitlements. Actually, the debt proves useful to sell military goods as an export. But the US dollar debt is really owned by those who use the US dollar. If Americans are forced to come to terms with the Price inflation while real value of labor goes down along with the Value of the US dollar, well, then another medium of exchange selected by Americans may have more impact than legislating out candidates neither republican nor democrat.

There was a report that Obama and McCain missed the filing deadline in Texas, and that the state would have to offer them an extension, which they don't do. In reality, though, it wasn't necessary for Obama and McCain to file.
