The Texas DA That Got Cheney and Gonzales Indicted Has Gone Missing.

advertisement

Willacy County prosecutor Juan Angel Guerra stumped a presiding judge and attorneys for clients as high up as Vice President Dick Cheney when he failed to show up to court on his own grand jury's indictments.

The no-show infuriated attorneys who'd spent the day milling about with what they'd hoped would be slam-dunk motions to quash the cases.

And it put Presiding Judge Manuel Bañales in a position he said he'd never been in before.

"At the very least I expected the district attorney to be here," Bañales said, asking Guerra's office manager, "Do you know where he is?"

Who's leading the conversation?
This visualization below allows you to see the impact that each user has on the current conversation. The top row contains the group of users who have had the most impact, the 2nd row the group of users who have had the 2nd most impact (et cetera). Users with similar impact are grouped together, and the average score of the group is shown to the left of the group. The author of the article is also shown on the left, in their corresponding group. Each user's score is based on the number of comments the user has made plus the number of votes their comments have received. The scores are calculated relative one another, so while their absolute value is not particularly important, their relative difference does indicate a larger difference in impact on the conversation.

I'm rarely one to jump on the conspiracy theory band-wagon.  Nine time out of ten... no... more like 99 times out of 100 there is a perfectly plausible explanation for things.

Hell, there's probably a perfectly plausible explanation for this.

But a DA in Texas indicts the Vice President of the United States and a former Attorney General/close personal friend of the President and then.... vanishes?

It reads like the plot of a John Grisham novel.... though Grisham would have set it in Alabama.

They're hiding him in Cheney's man-sized safe or he's sharing a space with Jimmy Hoffa... but seriously, this reeks to high heaven. I'm not going to go as far as saying that Cheney's people "took care of it" because it's more likely is that the locals who weren't too happy about this got a little carried away.

I would put NOTHING past Cheney and his gang of thugs.  There needs to be more questions asked about this and other 'detention' centers. Even if this is a sham, no thinking person should doubt the breach of civil rights brought about by these heinously corrupt men.  I hope they get to sample their own fare!

Look at this... DA in Cheney case explains failure to appear

At least a dozen defense lawyers did show up, armed with motions to have Monday’s grand jury indictments thrown out as baseless.

But presiding District Judge Manuel Bañales said that without the prosecutor present he could not hear those motions.

good job Banales! And Guerra. Looks like it "was" a delaying tactic...hahahaha...and he's alive(Guerra).lol

The judge and DA needed another day for the friday docket. The Quash motions and Dismissal motions would/could not be heard without the DA present...or could they have? He really could have just thrown the indictments out if he was hostile to Guerra.

Another bloody miracle! Practicing law at it optimum.Against crooks. Everyone help out so that these men(Cheney,Gonzales and the Geo thugs) will not subvert justice.

Nobody knew were Guerra was all day? :) And when his manager was asked if Guerra was...

When Bañales asked if she were concerned for Guerra’s safety she said she would not know how to answer the question

hahahaha lol Smart! Hispanics like me! hahahaha ...But I'm of Mexican heritage...Hora le hermanos. Gracias a Dios! Don't mind my jubilation.

Conspiracies rarely, rarely happen in politics, business or the covert world of intelligence.  99% of the time, political-economic arrangements are all out there, honest abe, cherry tree, above board, by the books, transparent and ready to verify. Documents on hand, shredders non-existent, redactions a thing of history, emails open to scrutiny, back-rooms locked, meetings held in public and recorded, feedback from the public solicited, conflicts of interest reported and forbidden, offshore bank accounts exposed and forbidden, blackmail and bribery unheard of, contract killings too fantastical to be imagined. Thank our open, equal, and just society that powerful interests are ready to come clean, that the stakes are just not high enough for anyone to bother with conspiracies. I'm relieved we live in such a plausible world.  Because I need it to be this way.

Sounds like a half ass prosecutor that knows he has a half ass case, that decided to not embarrass himself by showing up in court.

Anyway, I'd much rather see Cheney free to defend himself against the War Crimes charges that are lurking in the background for him and Bush and Rice.

Remember, these are the people that on false pretenses and lies, spearheaded the invasion of Iraq, resulting in the death of over 100,000 innocent Iraqi  men woman and children.

I want to see an indictment from the World Court, not some crackpot prosecutor from the somewhat twisted judicial system of Texas.

This question was not to me and so, as a typical slothful American, as contrasted by real Americans, I did not answer it. I was too busy doing slothful stuff like writing my representatives and open letters to Bush 43 to get involved.   However, since you are so positive Cheney is an 'innocent' here are some, just some, of the research sources for an article that I am writing.  Please read this, this, this, this and this

Shan,  Of course sloths exist.  I was married to two of them.  ;>)   It is just that they don't come in one political denomination, station in life, race, from any particular area of the country(even those that don't have 'real' Americans), gender, religion or any other particular box some people would label them with.

Slothful actions=slothful person.  Nothing else enters into it.  From your other comments, I know you understand this.

                  Regards

I think it's rather ridiculous that the charges were ever filed against Cheney and Gonzales.  I've read that the suit charges that by merely *investing* in Vanguard, that {at least} Cheney was guilty of a crime against prisoners detained in prison facilities.  (At least that was my interpretation of what I have read about the 'case'.)  Good grief. If this is truly the basis of this legal filing, I wonder why it is even newsworthy.  Waste of a court's time IMHO.

Maybe the DA is hiding out of embarrassment.  Maybe he experienced a moment of folly thoughts in filing the charges and never thought it would snowball into mainstream media. (???)

I'm not really in a position to comment on the charges themselves.  An indictment involves someone's discression other than that of the prosecutor, however, and consequently I don't think that one can reasonably point at the DA and say "the indictment was faulty and it's his fault."

That said, it's newsworthy because of what's involved in an indictment.  A grand jury indicated that this warranted further investigation.  That's serious.  The vanishing of the DA is newsworthy because, as other posters here have said, it "reeks to high heaven."

So as to underscore the significance of indictment, you might want to read up on it.

Al Capone was caught on tax evasion because he was too connected to get pinched on anything else.  Gotta start somewhere with these people.

Wow, I am just communicating what I've read from another source.  I would believe with every fiber of my being, that V.P. Cheney is going to be just fine.

I have an old school mate who went to law school; a brilliant person.  One of the first suits he filed after passing the bar exam, was to take on the state of Texas about one thing or another.  The basis of the suit (again, only stated as my own assessment) was for a cause he strongly believed in; one that he felt had validity.  He pursued his angle which had legitimacy in his own reasoning.  Didn't work; I don't think he has visited the state since.  He is still okay!  He just doesn't visit the state of Texas any longer.

Unfortunately Kill, it's a reasonably common aphorism in the legal community that any competent District Attorney can get a Grand Jury to indict a ham sandwitch.

so you agree that this criminal man should walk free? This is just the beginning. The DA probably started this because once someone is indicted it seems the whole mess is unraveled and exposed. This DA knows probably a whole lot but cannot touch the subjects for fear of this very thing, disappearing. Cheney is a ring-leader in our gov's crimes.

I would feel so much better if our courts brought down some of washington. I probably would start trusting them to do the right things. But for now, I see them (Washington and Wall Street) worse than I see the inmates at Tent City a block from my work.

Criminal? Really? Has he been convicted of a crime? Let's see a link.

Cheney is a ring-leader in our gov's crimes.

Really? Has that been proven in a court of law as well? Let's see a link.

Personally I'd like to see PE Obama, Rahm Emanuel, and their cabal of crony capitalists held accountable for their complicity in the Fannie/Freddie meltdown, but apparently no laws were broken so they're going to skate.

Okay partisanship would possibly fit this if Chaney or Gonzales was still to remain in office, I mean that is why they called the corruption case against Ted Stevens (Alaska) a witchhunt because he was running for another term in office.  Chaney is on his way out the door, and Gonzales is already gone, so how is this partisanship?

It's tempting to see this as just another conspiracy theory. Just as it is to believe that he's taking the safe option and gone into hiding to save his own skin, literally. Hope that's not in Cuba. Whichever way one sees it.

But I'll be amazed if this indictment goes all the way through. The thugs have already ensured that absolute power will keep them in the clear, if only just.

rick,  This article notwithstanding, please read this, this, this, this and this.  Then decide what the intentions, however mismanaged or incompetent they might be, of the DA are.  I have multiple other sources that I am not willing to share for the next few days. (I guess that I would have failed that part of kindergarten)

Oh, and besides, this is from the Express News.  You know............... Rupert.

I lived there(SA) for 25 years and have personal experience with a few of the writers and well......not exactly known for their journalistic tenacity. Write it fast, get it in print and to hell with the details.

That is NOT an indictment of Killies seed, however.  This needed to be posted. (Glad I cleared that up. Whew!)

She wasn't apologizing to Elliot's wife.  She was with Diane Sawyer in a very pricey-looking, proper blue dress.  I guess hooker dress code would not have cut it for a tete-a-tete with Ms. Sawyer.

The makeup still looked like one I might see on a local, "overpainted puta" to quote Sara Paretsky's "Fire Sale" book.

                        Lkessler,

When I refered to the apology to Elliott's wife, that was on a news show this past week. I believe the quote from the reporter was that she had made an attempt to apologize to Elliott's wife, but she was still looking to pen a book deal.

                          LOLOL!!

I totally agree, but what I want to know is, why is this chick not in jail or why no jail time for her since she has openly admitted to being a "call girl"?  Yep last time I checked the definition of that term it was the same as "Prostitute" which I thought was a crime and the level of this being a crime has nothing to do with the dollar amount you charge for said services.

Furthermore a ho is a ho is a ho, no matter what she's wearing or what she charges.  She still should have set her happy ass in jail and also should have a record of such charges.  Elliott resigned his job and was publicly humiliated (by his own actions, nonetheless) and now she's some kind of dam star. I bet Hollywood Blvd and a lot of other red light district ladies would like the celebrity status of sitting down with Diane Sawyer!

On the other hand if and when the prisoners in Guantanamo are released, I think they should be released in Crawford, TX and Casper, WY (home of Cheney).

Thats it Independentvoter!  Get that anger out over the results of the election.  Find any needless reason to insult someone who is not faithfully buying in to the Bush/Chaney administration "we've done nothing wrong!!!"

Overlook the fact that the same person your calling stupid may be the victim of a crime, and the fact that he was smart enough to accomplish something no one else has done, bring enough evidence out to get an indictment.  But hey, if Chaney's best interest is at heart I'm sure all the big dogs from the republican party can step up and speak for his character. Bush can still make one final pitty act and pardon him and Gonzales.

                            Hello Waynester,

I did read post 20, however the post I was responding to with my comment was trying to say that a democrat would be stupid enough to go on a hunting trip with Cheney.  While it was probably an attempt at humor, it is never a good thing to joke like that when someone is missing, which is the essential topic of the article that he was not in court.

BTW:  I'm also a ZZtop fan.  "Women really go crazy about a sharp dressed man"

What happens in Texas stays in Texas ? This administration will be one for historians to sort out for years to come. Can't wait for the movie to come out.

I absolutely love Texas.  I had to say that as I don't want the whole state to be associated with this whatever it is.  I don't even live there but I do have ties to this magnificent state.

That said, maybe it was nothing more than nerves.  Perhaps, we are just jumping to conclusions.  There are a million reasons other than what has been posted here.  But, there is a lot of prairie, I must admit.  Cactus, tumbleweeds, Longhorns, true prairie, coyotes, jack rabbits, wild boars, list goes on and on.

I'm stuck in Texas, and don't particularly like it.

Dallas is full of pretentious snobs, many whom I think are masquerading on lines of credit.

Like I always said "I can't love anything that is flat and ugly"

I love Wichita Falls and Henrietta which is about 20 miles east of Wichita Falls.  I have family in every part of Texas.  Love the state!!!

I love the terrain, the Texas Blue Bonnets, the Jack rabbits, the howl of the coyote, the smell of the skunk as it goes under the farm house, the sunsets, the oil derricks, the smell, the air, the cowboys and I don't mean the football team, my list goes on forever and ever.

Oh, once you get used to it.........it is still hot as hell.  But there is so much more here to do and see than I ever thought( and I have been some places Lampasas, Buda, Del Rio: just kidding).  Lived 25 years in San Antonio and I will NEVER move back.  Been to many parts of the world and here is where I will stay(unless I get to be Queen of Ireland).  The big H is so much more fun!

Come on down, Sue, and we will show y'all a great time.

Come on this guy probably woke up from what ever drug induced coma he was in and said what am I doing?  and is too embarrassed to show up at court.  This is ridiculous, this is how Dem's don't let things go, No crime, just like Obama's has no ties to Ayers, and didn't get brainwashed by listening  to Rev. Wright for 20+ years.  Move On!
